EXPLANATORY STATEMENT

International Organizations (Privileges and Immunities) Act 1963

International Organization for Migration (Privileges and Immunities) Regulations (Amendment)

Section 13 of the International Organizations (Privileges and Immunities) Act 1963 (the Act) provides that the Governor-General may make regulations, not inconsistent with the Act, prescribing all matters which are required, or which are necessary or convenient to be prescribed, for carrying out or giving effect to the Act.

The purpose of the Regulations is to rectify drafting errors in Regulations 3 and 6 of the International Organization for Migration (Privileges and Immunities) Regulations.

The amendment to Regulation 3 clarifies that the International Organization for Migration is an "international organisation" to which the Act applies. The new Regulation 6 makes clear that the privileges and immunities specified in paragraphs 1, 2, 3, 4, 5 and 6 of Part 1 of the Fourth Schedule to the Act apply to officers of the Organisation only and that the privileges and immunities specified in Part 11 of the Fourth Schedule to the Act apply to former officers of the Organisation only.
