Mutual Assistance in Criminal Matters Act 1987

Mutual Assistance in Criminal Matters (France) Regulations

Section 44 of the Mutual Assistance in Criminal Matters Act 1987 (the Act) provides that the Governor-General may make regulations for the purposes of the Act. Subsection 7(2)(b) provides that regulations may make provision that the Act applies to a specified foreign country subject to limitations, conditions, exceptions or qualifications. Subsection 7(2A) provides that regulations may make provision that the Act applies to a specified foreign country in respect of obtaining access, for the purpose of international assistance in criminal matters, to CTR information (information provided under the Cash Transaction Reports Act 1988) subject to such limitations, conditions, exceptions or qualifications or other modifications as are specified in the regulations.

The proposed Regulations apply the Act to France other than Parts I, III, IV, V, VI and VII of the Act.

They are necessary to enable CTR information to be exchanged between Australia and France pursuant to a recently signed Memorandum of Understanding.
