EXPLANATORY STATEMENT

National Health Amendment Regulations 2001 (No. 1)

Section 140 of the National Health Act 1953 (the Act) provides that the Governor-General may make Regulations for the purposes of the Act.

Subsection 140(2) of the Act makes provision to preclude or modify, by regulation, a specified provision of the Act relating to an applicable benefits arrangement, for a specified registered health benefits organisation. This provision has been used to permit pilot or demonstration schemes which could lead to an enhancement of the health insurance industry.

Regulation 4B of the National Health Regulations (the Principal Regulations) modifies the operation of the Act in relation to applicable benefits arrangements provided for specified registered health benefits organisations participating in the programs. In other words, it allows for patients to be paid health insurance benefits for hospital type treatment rendered to them in community settings.

The Regulations amending Regulations 4B of the Principal Regulations to:

*       substitute references to Medibank Private with Medibank Private Limited;

*       add Health Partners Incorporated to the Hospital to Home Trial (Ashford Community Hospital (SA));

*       extend the Epworth Hospital in the Home Pilot Project for a further three months to 30 June 2001; and

*       add National Mutual Health Insurance Pty Ltd to the Epworth Hospital in the Home Pilot Project;

*       adjust the lettering of the participating funds listed in Schedule 3 to accommodate the addition of Health-Partners Incorporated and National Mutual Health Insurance Pty Ltd.

Details of the Amending Regulations are set out in the Attachment.

The Amending Regulations commence on gazettal.

ATTACHMENT

NOTES ON CLAUSES

Regulation 1 provides that the Regulations may be cited as the National Health Amendment Regulations 2001 (No. 1).

Regulation 2 provides that the Regulations commence on gazettal.

Regulation 3 provides that the National Health Regulations 1954 are amended by Schedule 1.

Items 1, 2 and 3 of Schedule 1 substitute Medibank Private with Medibank Private Limited. This will have the effect of correctly describing the registered health benefits organisation Medibank Private Limited.

Item 4 of Schedule 1 adds Health-Partners Incorporated to the Hospital to Home Trial (Ashford Community Hospital (SA)).

Item 5 of Schedule 1 omits the date currently included in subregulation 4B(5B) and inserts the new date of 30 June 2001. This will have the effect of extending the Epworth Hospital-in-the-Home Pilot Project for a further three months to 30 June 2001.

Item 6 of Schedule 1 adds National Mutual Insurance Pty Ltd to the Epworth Hospital-in-the-Home Pilot Project.

Item 7 of Schedule 1 omits the date currently included in subregulation 4B(10) and inserts the new date of 30 June 2001. This will have the effect of extending the Epworth Hospital-in-the-Home Pilot Project for a further three months to 30 June 2001.

Item 8 of Schedule 1 inserts Health-Partners Incorporated. This has the effect of including HealthPartners Incorporated to the Hospital to Home Trial (Ashford Community Hospital (SA)) and requiring the relettering of the other participating funds.

Item 9 of Schedule 1 inserts National Mutual Insurance Pty Ltd. This has the effect of including National Mutual Insurance Pty Ltd in the Epworth Hospital-in-the-Home Pilot Project and requiring the relettering of the subsequent participating funds.
