EXPLANATORY STATEMENT

Statutory Rules 1995 No. 138

Issued by the Authority of the Special Minister of State

Ombudsman Act 1976

Ombudsman Regulations (Amendment)

Section 38 of the Ombudsman Act 1976 (the Act) provides that the Governor-General may make regulations for the purposes of the Act.

Regulation 5 (Schedule 2) of the Ombudsman Regulations (the Principal Regulations) specifies the prescribed authorities for the purposes of the Act; and Regulation 9 (Schedule 4) specifies the principal offices in respect of prescribed authorities.

On 30 May 1994 the Transport and Communications Legislation Amendment Act 1994 came into effect and changed the name of the (former) Australian and Overseas Telecommunications Corporation Limited to "Telstra Corporation Limited". In addition, the listing for the (former) Board of Trustees of the Australian War Memorial had not been amended since the body was renamed the "Council of the Australian War Memorial".

The purpose of the proposed Regulations is to update update references to those authorities.

Regulation 1 is a citation provision.

Regulation 2 omits the previous schedule 2 and re-lists prescribed authorities in alphabetical order, replacing "Australian and Overseas Telecommunications Corporation Limited" with "Telstra Corporation Limited".

Regulation 3 omits the previous schedule 4 and re-lists, principal offices in respect of prescribed authorities in alphabetical order, replacing "Australian and Overseas Telecommunications Corporation Limited" with "Telstra Corporation Limited: and "Board of Trustees of the Australian War Memorial" with "Council of the Australian War Memorial".
