Primary Industries Levies and Charges (National Residue Survey Levies) Amendment Regulations 1999 (No. 4)

Section 30 of the Primary Industries Levies and Charges Collection Act 1991, Section 8 of the National Residue Survey (Customs) Levy Act 1998 and Section 8 of the National Residue Survey (Excise) Levy Act 1998 provide that the Governor-General may make regulations prescribing matters required or permitted to be prescribed by the Acts, or necessary or convenient to be prescribed for carrying out or giving effect to the Acts.

The purpose of the regulations is to move the collection period for the macadamia nut levy from a six-month period to a calendar month period from 1 January 2000. This amendment will allow for a more consistent cash flow to be maintained for industry to meet its ongoing commitment to residue monitoring, research and development and marketing strategies.

Also considered at the same meeting were the Primary Industries Levies and Charges Collection (Macadamia Nut) Amendment Regulations 1999 under the Primary Industries Levies and Charges Collection Act 1991, the Primary Industries (Customs) Charges (Macadamia Nut) Regulations 1999 under the Primary Industries (Customs) Charges Act 1999 and the Primary Industries (Excise) Levies (Macadamia Nut) Regulations 1999 under the Primary Industries (Excise) Levy Act 1999.

The regulations will also amend the meaning of 'value' in the coarse grain and wheat schedules of the Primary Industries Levies and Charges (National Residue Survey Levies) Regulations 1998 so that they are consistent with the Coarse Grains Levy Collection Regulations and the Wheat Levy Collection Regulations.

The National Residue Survey implements chemical residue monitoring programs and recovers the costs of the programs from participating industries. These programs form the basis for documentation that enables the Australian Government to certify that raw food products bound for export and domestic consumption are free from significant chemical contamination.

Schedule 1 of the regulations substitutes the meaning of 'value' at regulation 34, Part 4 (Coarse Grains) and regulation 252, Part 18 (Wheat) of the Primary Industries Levies and Charges (National Residue Survey Levies) Regulations 1998 with that contained in the Primary Industries Levies and Charges Regulations 1999.

Schedule 2 of the proposed regulations moves the collection period for the macadamia nut levy from a six-month period to a calendar month period from 1 January 2000.

Schedule 1 of the proposed regulations will commence on gazettal, while Schedule 2 will commence on 1 January 2000.
