EXPLANATORY STATEMENT

STATUTORY RULES 1994 No. 468

Protection of the Sea (Prevention of Pollution from Ships) Act 1983

Protection of the Sea (Prevention of Pollution from Ships) (Orders) Regulations

Subsection 33(1) of the Protection of the Sea (Prevention of Pollution from Ships) Act 1983 (the Act) provides that the Governor-General may make regulations, not inconsistent with the Act, prescribing all matters required or permitted to be prescribed or which are necessary or convenient to be prescribed for carrying out or giving effect to the Act.

The detailed subordinate requirements of the Act have been incorporated in Marine orders made by the Australian Maritime Safety Authority pursuant to the provisions of subsection 34(1) of the Act.

Paragraph 33(1)(f) of the Act provides for the making of regulations to prescribe penalties for a contravention of, or a failure to comply with, an order made under section 34.

Details of the regulations are:

Regulation 1 provides for the citation of the regulations.

Regulation 2 provides that the regulations commence on 10 January 1995.

Regulation 3 provides for interpretation in the application of the regulations.

Regulation 4 provides that it is an offence not to comply with a provision of orders made under subsection 34(1) of the Act that are expressed to be penal provisions.
