Registration of Deaths Abroad Act 1984

Registration of Deaths Abroad Amendment Regulations 2004 (No. 1)

Section 28 of the Registration of Deaths Abroad Act 1984 (the Act) provides that the Governor-General may make regulations, not inconsistent with the Act, prescribing matters required or permitted by the Act to be prescribed, or necessary and convenient to be prescribed for carrying out or giving effect to the Act.

The purpose of the proposed Regulations is to effect consequential amendments to the Registration of Deaths Abroad Regulations (the Prinicipal Regulations) as a result of the enactment of the Military Rehabilitation and Compensation Act 2004. The proposed Regulations would amend Forms 1 and 2 in Schedule I to include a reference to a person receiving benefits under the Military Rehabilitation and Compensation Act 2004.

The Regulations would also update references to the Social Security Act 1991 (superseding the Social Security Act 1947) and the Veterans' Entitlements Act 1986 (superseding the Repatriation Act 1920) and update the name of the Principal Regulations in line with current drafting practice.

Details of the proposed Regulations are set out in the Attachment.

The Regulations commence on 1 July 2004.

DETAILS OF THE PROPOSED REGISTRATION OF DEATHS ABROAD AMENDMENT REGULATIONS 2004 (No. 1)

Regulation 1 provides that the Regulations are the Registration of Deaths Abroad Amendment Regulations 2004 (No. 1).

Regulation 2 provides that the Regulations commence on 1 July 2004.

Regulation 3 provides that the Registration of Deaths Abroad Regulations (the Principal Regulations) are amended as set out in Schedule 1.

Schedule 1

Item 1:

This updates the name of the Principal Regulations in accordance with current drafting practice.

Items 2 and 4:

This deletes references in Schedule 1, Forms 1 and 2 to the Social Security Act 1947 and substitutes Social Security Act 1991.

Items 3 and 5:

This deletes references in Schedule 1, Forms 1 and 2 to the Repatriation Act 1920 and substitutes Veterans' Entitlements Act 1986. This also inserts in Schedule 1, Forms 1 and 2 a reference to a person receiving benefits under the Military Rehabilitation and Compensation Act 2004.
