Veterans' Entitlements Regulations (Amendment)

Issued by authority of the Minister for Veterans' Affairs

The Governor-General may make regulations under section 216 of the Veterans' Entitlements Act 1986 (the Act) for the purposes of the Act.

The former section 60 of the Act described the powers of the Repatriation Commission or its delegate when conducting a review under section 59 of the Act.

Subsection 60(2) described the powers of the Commission if it conducts the review itself: it may summon a person to appear at a hearing of the review, and require a person appearing at a hearing of the review to take an oath or affirmation for the purpose of giving evidence or administer an oath or affirmation to a person so appearing.

Subsection 60(3) described the powers of a delegate of the Commission who is conducting the review. These are the same as the powers of the Commission.

For the purposes of conciseness and simplicity, in the course of rewriting Part III of the Act in "plain English", the two provisions have been merged in the new subsection 57F(2).

The Regulations amend Regulation 4. Schedule 1, Form 2 is also amended. In both instances, the amendment is effected by substituting the words "subsection 57F(2)" for "subsection 60(2) or (3)" or "subsection 60(2)/subsection 60(3)" whenever occurring.
