ABORIGINAL LAND RIGHTS ACT 1983 - SECT 235
Registrar may issue compliance directions
(1) Any person or body may request the Registrar to issue a direction to an
Aboriginal Land Council or an officer of an Aboriginal Land Council requiring
the Council or officer to comply with a specified provision or provisions of
this Act or of any regulations or rules made under this Act.
(2) If the
Registrar is satisfied that an Aboriginal Land Council or an officer of an
Aboriginal Land Council has failed to comply, or is not complying, with a
specified provision or provisions of this Act or of any regulations or rules
made under this Act, the Registrar may issue a direction to the Council or
officer requiring the Council or officer to comply with that provision or
those provisions within a time stated in the direction.
(3) The Registrar is
not to issue a direction under this Part in relation to any matter if-- (a)
the matter could constitute an offence under this Act or any other law, or
(b) provision is made for the determination of the matter under another
section of this Act.
(4) In this section--
"officer" , in relation to an Aboriginal Land Council, includes-- (a) for a
Local Aboriginal Land Council--the chief executive officer of the Council, and
(b) for the New South Wales Aboriginal Land Council--the Chief Executive
Officer of the Council.
