Compulsory mediation of land dealing application disputes
239A Compulsory mediation of land dealing application disputes
(1) This section applies to a dispute relating to a decision by the
New South Wales Aboriginal Land Council under Division 4 of Part 2 to approve
or not to approve a land dealing.
(2) A Local Aboriginal Land Council must,
if the Council proposes to commence legal proceedings in relation to the
dispute, refer the dispute to the Registrar.
(3) The Registrar may, with the
parties consent-- (a) attempt to resolve the dispute by mediation,
conciliation or arbitration, or
(b) refer the dispute to mediation,
conciliation or arbitration by an independent person.
