BIRTHS, DEATHS AND MARRIAGES REGISTRATION ACT 1995 - SECT 42
Registration
42 Registration
(1) The Registrar registers a death by making an entry about the death in the
Register including the particulars required by the regulations.
(2) However,
if the particulars available to the Registrar are incomplete the Registrar may
register a death on the basis of incomplete particulars.
(3) If the Registrar
receives a cause of death certificate referred to in the
Voluntary Assisted Dying Act 2022 , section 87(6), the Registrar must
register the death in the Register by making an entry about the death that
records-- (a) the cause of death as the disease, illness or medical condition
with which the person had been diagnosed that made the person eligible to
access voluntary assisted dying, and
(b) the person was the subject of a
voluntary assisted dying authority under the Voluntary Assisted Dying Act
2022 and voluntary assisted dying was the manner of death.
