BOARDING HOUSES ACT 2012 - SECT 90
General provisions relating to notices under this Part
90 General provisions relating to notices under this Part
(1) This section applies in relation to the issuing of notices by the
Secretary or an enforcement officer under this Part or regulations for this
Part.
(2) A notice must be- (a) in writing, and
(b) served on the person on
whom it is required to be served by the provision under which it is issued.
(3) A notice has effect on the day on which it is served or on such later day
as may be specified in the notice or specified by the provision under which it
is issued.
(4) A notice (other than a cancellation or revocation notice that
has already taken effect) may be varied or revoked by a further notice served
on the person on whom the original notice was served.
(5) A notice may be
varied by modification of, or addition to, its terms and specifications.
(6)
The revocation or variation has effect when notice of the revocation or
variation is served on the person to whom the original notice was issued.
(7)
Without limiting the above, a notice may be varied by extending the time for
complying with the notice.
(8) The revocation of a notice does not prevent
the issue of another notice.
(9) A notice is to be in the approved form,
subject to any other requirements of the regulations or the provision of this
Part under which a notice is issued.
