125 Attornment etc
(1) Upon a conveyance of the reversion or remainder expectant or depending
upon a lease of any land no attornment by the lessee under the lease shall be
necessary.
(2) No lessee shall be prejudiced or damaged by payment of any
rent to any grantor, transferror, or assignor of any reversion, or by breach
thereby occasioned of any condition for non-payment of rent, before notice is
given to the lessee of such grant, transfer, or assignment by the grantee,
transferee, or assignee.
(3) An attornment by a lessee of land to a stranger
claiming title to the estate of the lessor shall be void unless the same is
made with the consent of the lessor.
(4) Sections nine and ten of the
Imperial Act Four Anne, chapter sixteen (or chapter three), and section eleven
of the Imperial Act Eleven, George the Second, chapter nineteen, are hereby
repealed, so far as the same apply to New South Wales.
