Consolidation of mortgages abolished
97 Consolidation of mortgages abolished
(1) A mortgagor seeking to redeem any one mortgage made after the commencement
of this Act shall by virtue of this Act be entitled to do so without paying
any money due under any separate mortgage made whether before or after the
commencement of this Act by the mortgagor or by any person through whom the
mortgagor claims on property other than that comprised in the mortgage which
the mortgagor seeks to redeem.
(2) This section applies notwithstanding any
stipulation to the contrary.
(3) This section applies to mortgages under the
Real Property Act 1900 .
