(1) This section applies to the following persons:(a) an authorised carer or a carer applicant,(b) a guardian or a prospective guardian,(c) a person who resides on the same property as a person referred to in paragraph (a) or (b).
(2) Any person (the
"provider of information" ) may provide information to a designated agency about another person if the provider of information:(a) has been notified by the designated agency, the Children's Guardian or the Secretary that the other person is a person to whom this section applies, or(b) otherwise reasonably believes the other person to be a person to whom this section applies.
(3) A designated agency may use any such information to determine whether a person is suitable to be, or to continue to be, an authorised carer or guardian.
(4) Information may be provided under this section regardless of whether the provider has been requested to provide the information.
(5) For the purposes of this section:
"reside on a property" has the same meaning as in the Child Protection (Working with Children) Act 2012 .
