Nature of proceedings for offences
104 Nature of proceedings for offences
(1) Proceedings for an offence under this Act or the regulations may be dealt
(a) summarily before the Local Court, or
(b) summarily before the
Supreme Court in its summary jurisdiction.
(2) If proceedings are brought in
the Local Court, the maximum monetary penalty that the Local Court may impose
for the offence is the lesser of:
(a) 200 penalty units (in the case of an
individual) or 500 penalty units (in the case of a corporation), despite any
higher maximum monetary penalty provided in respect of the offence, or
the maximum monetary penalty provided by this Act in respect of the offence.
(3) Proceedings for an offence under this Act or the regulations must be
commenced not later than 2 years from when the offence was alleged to have

the death of a person that is or has been the subject of a coronial inquest
that concludes later than 2 years from when the offence was alleged to have
been committed, the proceedings must be commenced not later than 6 months
after the conclusion of the inquest.
