DANGEROUS GOODS (ROAD AND RAIL TRANSPORT) ACT 2008 - SECT 44
Internal review of exemptions by Competent Authority
(1) If a Competent Authority-- (a) refuses to grant an exemption to a person
or a class of persons, or
(b) cancels an exemption granted to a person or a
class of persons, or
(c) grants an exemption to a person or a class of
persons subject to conditions, or
(d) varies or cancels conditions to which
an exemption granted to a person or a class of persons is subject or imposes
new conditions,
the person or a representative of the class of persons may
apply in writing to the Competent Authority for a review of the decision.
(2)
The application for review must be made within 7 days after the decision or,
if the regulations prescribe a different period, within the period so
prescribed.
(3) An application for review may be made only once in respect of
any particular decision.
(4) The Competent Authority is to review the
decision that is the subject of a duly made application for review.
(5) The
Competent Authority may stay a decision that is the subject of a duly made
application for review.
(6) The Competent Authority may, as a result of the
review, confirm the decision, vary it or revoke it. The confirmation,
variation or revocation has effect when notice of the result of the review is
given to the applicant.
(7) Regulations may be made with respect to reviews
under this section.
