Prohibiting a person from involvement in the dangerous goods transport industry
54 Prohibiting a person from involvement in the dangerous goods transport
industry
(1) In sentencing an offender for an offence, a court may, having regard to
the matters referred to in subsection (2) and to such other matters as it
thinks fit, order that the offender be prohibited for a specified period from
involvement in the transport of dangerous goods by road or rail.
(2) The
matters to which a court must have regard are-- (a) the offender's record in
the transport of dangerous goods by road or rail, and
(b) any prior
convictions of the offender relating to dangerous goods, and
(c) the
circumstances surrounding the commission of the offence for which the offender
is being sentenced.
(3) A person who contravenes an order under this section
is guilty of an offence. : Maximum penalty--500 penalty units or imprisonment
for 2 years, or both, for an individual or 2,500 penalty units for a body
corporate.
