DIRECTOR OF PUBLIC PROSECUTIONS ACT 1986 - SECT 9A
Handing back of matters to original prosecutor
(1) If a prosecution or proceeding that has been taken over by the Director
under section 9 is remitted to the Local Court, the Director may hand the
matter back to the prosecutor from whom it was taken over (the
"original prosecutor" ) or, if the original prosecutor (being a holder of a
position in the Public Service or as a member of the NSW Police Force) no
longer holds that position, to the person now holding that position (the
"original prosecutor's successor" ).
(2) If a matter is handed back under
this section, the original prosecutor or the original prosecutor's successor,
as the case may be, shall, as from the time when the Director complies with
section 10 (1A) in relation to the matter, be deemed to be the prosecutor in
connection with the matter.
