51 Determination by Minister of applications for initial registration of new
non-government schools etc
(1) As soon as practicable after receiving the report of the Authority about
an application for registration of a non-government school, the Minister-- (a)
is to register the school in the Register kept by the Minister for the purpose
and issue to the applicant a certificate of registration for the school, or
(b) is to refuse to register the school.
(2) The Minister is to register the
school if the Minister, having considered the Authority's report and any
decision of the Tribunal, is satisfied that the requirements for registration
will be complied with at the school.
(3) If the Authority has recommended
that a school not be registered, the Minister may not refuse to register the
school unless-- (a) 30 days have elapsed since the applicant was given written
notice of the Authority's recommendation and no application has been made to
the Tribunal for an administrative review of the recommendation within those
30 days, or
(b) the Tribunal has determined an application for an
administrative review (made within those 30 days) of the recommendation and
the Minister has considered any contrary recommendation of the Tribunal and
the reasons for it, or
(c) any such application for an administrative review
of the recommendation has been withdrawn.
(4) The Minister is to give an
applicant written notice of a decision to refuse to register a school.
