(1) A compliance certificate is required in relation to building work or subdivision work in such circumstances as are prescribed by the regulations.Note : For example, the regulations require compliance certificates to be obtained for certain fire safety aspects of development before a complying development certificate, construction certificate or occupation certificate can be issued and require compliance certificates to be obtained for certain alternative solutions to the BCA before a complying development certificate can be issued.
(2) A condition of a development consent has no effect to the extent that it requires a compliance certificate to be obtained in respect of any development.
(3) A certifier may obtain a compliance certificate from another person in relation to building work or subdivision work for which the certifier is responsible even if a compliance certificate is not required.
