Effect of enforcement action on vehicle insurance
70 Effect of enforcement action on vehicle insurance
(1) A vehicle insurance policy is not terminated by the cancellation of the
registration of the vehicle under this Division or the suspension or
cancellation of the driver licence of the driver of the vehicle under this
Division.
(2) A claim under a vehicle insurance policy cannot be refused
merely because the vehicle's registration is cancelled under this Division or
the driver licence of the driver of the vehicle is suspended or cancelled
under this Division.
(3) This section has effect despite anything to the
contrary in a vehicle insurance policy or any other agreement.
(4) In this
section, a
"vehicle insurance policy" is a policy of insurance in respect of damage or
loss caused by or arising out of the use or operation of a vehicle (other than
a third-party policy within the meaning of the Motor Accidents Compensation
Act 1999 ).
Note : Section 14 of the Motor Accidents Compensation Act 1999
provides that a third-party policy under that Act relating to personal injury
is not cancelled by the cancellation of the registration of a motor vehicle
under this Division.
