Orders restricting development etc
161 Orders restricting development etc
(1) If an owner of an item on whom a notice is served under section 160 (1)
with respect to that item fails to show cause as referred to in section 160
(1), the Minister may, by order published in the Gazette, direct either of the
following-- (a) that no development or use of the land on which that item is
or was situated, or, where that item is a place, that place, is to be carried
out during such period, not exceeding 10 years, as is specified in the order
other than development or use of that land or place for the purpose of
restoring that item to the condition it was in before the demolition, damaging
or despoliation took place,
(b) that no development or use of the land on
which that item is or was situated is to be carried out other than development
or use of the building envelope (that is, the three dimensional space)
occupied by the item before the demolition, damaging or despoliation took
place.
(2) An order made by the Minister under subsection (1) shall take
effect on and from the date of publication of that order in the Gazette.
