Appeal by an applicant as to whether a "deferred commencement" approval operates
177 Appeal by an applicant as to whether a "deferred commencement" approval
operates
(1) An applicant who is dissatisfied with a decision that a council
is not satisfied as to a matter, being a matter as to which it must be
satisfied before a "deferred commencement" approval under section 95 can
operate, may appeal to the Land and Environment Court.
(2) The appeal must be
made within 12 months after the council notifies the applicant of its
decision.
