(a) has given notice under section 83 to the holder of a certificate of its proposed action; and
(b) the time specified in the notice for a response from the holder has expired--it may, after considering any response made by the holder, by notice in writing given to the holder, take the proposed action or take less onerous action that it considers appropriate.
