NATIONAL PARKS AND WILDLIFE ACT 1974 - SECT 71N
Tabling of proposal if change of land classification involved
71N Tabling of proposal if change of land classification involved
(1) This section applies if, as a result of negotiations concerning Schedule
14 lands, it is proposed that the classification of the lands concerned under
this Act, as listed in Schedule 14, be changed to another classification (such
as, for example, from a nature reserve to a national park) when the lands are
vested in an Aboriginal Land Council or Councils under this Part.
(2) The
Minister is to cause a notification of such a proposal to be laid before each
House of Parliament as soon as practicable after the parties to the
negotiations decide that the classification of the lands should be changed.
(3) If a House of Parliament passes a resolution of which notice has been
given within 15 sitting days of that House after a notification has been laid
before it (whether or not those sitting days occur during the same session)
and the resolution disallows the notification, no further action is to be
taken in the matter.
(4) Nothing in this section prevents the Minister, at
some later time, causing to be laid before each House of Parliament in
accordance with this Division a notification that has previously been tabled,
either with or without amendments.
