Extension of orders for periodic maintenance
37 Extension of orders for periodic maintenance
(1) Where a court has made an order under this Part for periodic maintenance
for a period which is less than the maximum period permissible in accordance
with section 30, the person in whose favour the order is made may, at any time
before the expiration of that maximum period, apply to the court for an
extension of the period for which the order applies.
(2) A court shall not
make an order pursuant to an application under subsection (1) unless it is
satisfied that there are circumstances which justify its so doing.
(3) An
order extending the period for which an order under this Part for periodic
maintenance applies may not be made so as to extend the period beyond the
maximum period permissible under section 30 in relation to the secondmentioned
order.
(4) For the purposes of this section, a court shall have regard to the
provisions of sections 26 and 27.
