PUBLIC INTEREST DISCLOSURES ACT 1994 - SECT 12B
Disclosure concerning local government
12B Disclosure concerning local government
(1) To be protected by this Act, a disclosure by a public official to the
local government investigating authority must-- (a) be made in accordance with
the Local Government Act 1993 , and
(b) be a disclosure of information that
the person making the disclosure honestly believes, on reasonable grounds,
shows or tends to show corrupt conduct, maladministration, serious and
substantial waste of local government money,
government information contravention or
local government pecuniary interest contravention by any one or more of the
following-- (i) a local government authority,
(ii) a delegate of a
local government authority,
(iii) a councillor (within the meaning of the
Local Government Act 1993 ),
(iv) a member of a county council (within the
meaning of the Local Government Act 1993 ),
(v) a member of staff of a
local government authority,
(vi) a representative on the board of a joint
organisation within the meaning of the Local Government Act 1993 .
(2) In
this section,
"local government money" includes all revenue, loans and other money
collected, received or held by, for or on account of a
local government authority.
