ROADS ACT 1993 - SECT 152H
Effect of registration of sale or disposal
152H Effect of registration of sale or disposal
(1) On the transfer registration for a Crown road or part of the Crown road
concerned-- (a) the road or part ceases to be a Crown road, and
(b) the
rights of passage and access that previously existed in relation to the road
or part are extinguished.
(2) The transfer registration for the Crown road or
part of the Crown road occurs-- (a) for land to which the Real Property Act
1900 applies--when the interest of the purchaser or transferee is registered
in the Register kept under that Act, or
(b) for land to which the Real
Property Act 1900 does not apply--when the interest of the purchaser or
transferee is recorded in the General Register of Deeds kept under the
Conveyancing Act 1919 .
(3) No compensation is payable for the
extinguishment of any rights of passage or access because of the operation of
this section.
