RESIDENTIAL (LAND LEASE) COMMUNITIES ACT 2013 - SECT 108
Referral of prospective home owner to operator
(1) A home owner must ensure that a genuine prospective home owner of the home
is advised to contact the operator of the community about the proposed sale
before a contract for the sale of the home is entered into, unless the
home owner is aware that contact has already been made. Note : This section
helps the operator to comply with the disclosure obligations under Part 4.
(2) A contract of sale or site agreement is not invalidated by a partial or
complete failure of-- (a) the home owner to comply with subsection (1), or
(b) the prospective home owner to contact the operator as contemplated by that
subsection or to continue contact, or
(c) the operator to respond to contact
from a prospective home owner as contemplated by that subsection.
