Right of home owner to appoint agent
46 Right of home owner to appoint agent
(1) A home owner may appoint a person as the home owner's agent for the
purpose of receiving notices or other documents to be given to the home owner
under a site agreement or under this Act. Note : For example, a home owner may
wish to appoint an agent if the home owner cannot read or write English, is
sick, or is going to be away from his or her home for some time.
(2) An
appointment of the operator of the community (or a close associate of the
operator or a person nominated by the operator) as an agent under this section
is of no effect.
(3) An appointment under this section-- (a) may be made in a
site agreement or at any time after the agreement commences, and
(b) may be
revoked at any time by the home owner,
but any such appointment or revocation
has no effect until it is notified in writing to the operator.
(4) The
operator must give to the agent appointed by a home owner, until such time as
the appointment expires or is revoked, any notices or other documents that the
operator is required to give to the home owner under a site agreement or this
Act.
(5) A notice or other document that is required by this section to be
given to the agent appointed by the home owner and that is not so given is
taken not to have been given to the home owner.
