Meaning of "prescribed CPI variation"
102A Meaning of "prescribed CPI variation"
(1) In relation to a proposed variation in recurrent charges that is the first
variation under a village contract, the
"prescribed CPI variation" is, for the purposes of this Division, the
variation that would result from the recurrent charges being increased in
proportion to the difference between-- (a) the Consumer Price Index published
most recently before the village contract was entered into, and
(b) the
Consumer Price Index published most recently before the written notice of the
proposed variation is given,
rounded to the nearest dollar.
(2) In relation
to a proposed variation in recurrent charges that is not the first variation
under a village contract, the
"prescribed CPI variation" is, for the purposes of this Division, the
variation that would result from the recurrent charges being increased in
proportion to the difference between-- (a) the Consumer Price Index published
most recently before those charges were last varied, and
(b) the
Consumer Price Index published most recently before the written notice of the
proposed variation is given,
rounded to the nearest dollar.
