Right to appoint agent
68 Right to appoint agent
(1) A resident of a retirement village may appoint a person as the resident's
agent for the purpose of receiving notices or other documents to be given to
the resident under a village contract or under this Act. Note--: A resident
may wish to appoint an agent if the resident (for example) cannot read or
write English, is sick, or is going to be away from his or her
residential premises for some time.
(2) An appointment of the operator of the
retirement village (or a close associate of the operator or a person nominated
by the operator) as an agent under this section is of no effect.
(3) An
appointment under this section-- (a) may be made in a village contract or at
any time after the contract commences, and
(b) may be revoked at any time by
the resident,
but any such appointment or revocation has no effect until it is
notified in writing to the operator of the village.
(4) The operator must
give to the agent appointed by a resident, until such time as the appointment
expires or is revoked, any notices or other documents that the operator is
required to give to the resident under a village contract or this Act.
(5) A
notice or other document that is required by this section to be given to the
agent appointed by the resident and that is not so given is taken not to have
been given to the resident.
