RETIREMENT VILLAGES ACT 1999 - SECT 9
"Consent" of residents
9 "Consent" of residents
(1) Schedule 1 provides for the way in which the residents of a
retirement village give their consent to a proposed measure or action relating
to the village for the purposes of this Act or the regulations.
(2) If a
resident or the operator of a retirement village considers that-- (a) the
residents' consent to a particular measure or action has been obtained
otherwise than as provided for by Schedule 1, or
(b) the votes of the
residents were inaccurately counted,
the resident or operator concerned may
apply to the Tribunal for an order as to the validity of the consent.
(3) On
an application made to it under this section, the Tribunal may make an order--
(a) declaring the consent to have been validly obtained, or
(b) voiding the
purported consent and directing that the residents vote again on the proposed
measure or action.
