SURROGACY ACT 2010 - SECT 27
Age of birth mother
(1) The birth mother must have been at least 25 years old when she entered
into the surrogacy arrangement.
(2) For a
pre-commencement surrogacy arrangement, it is sufficient that the birth mother
was at least 18 years old when she entered into the surrogacy arrangement.
(3) In all cases, it is a mandatory precondition to the making of a
parentage order that the birth mother was at least 18 years old when she
entered into the surrogacy arrangement.
