Inspection of records by Inspector

48 Inspection of records by Inspector

(1) The Inspector must, from time to time, inspect the records of each law enforcement agency (other than the Australian Crime Commission) to determine the extent of compliance with this Act by the agency and law enforcement officers of the agency.
Note : Under section 55 of the Surveillance Devices Act 2004 of the Commonwealth, the Commonwealth Ombudsman is required to inspect the records of the Australian Crime Commission to determine the extent of the Commission's compliance with this Act. Under section 61 of that Act, the Commonwealth Ombudsman is required to report the results of the inspection to the Commonwealth Minister, lay the report before the Commonwealth Parliament and send a copy of the report to the Minister administering this Act.
(2) For the purpose of an inspection under this section, the Inspector--
(a) after notifying the chief officer of the agency, may enter at any reasonable time premises occupied by the agency, and
(b) is entitled to have full and free access at all reasonable times to all records of the agency that are relevant to the inspection, and
(c) may require a member of staff of the agency to give the Inspector any information that the Inspector considers necessary, being information that is in the member's possession, or to which the member has access, and that is relevant to the inspection.
(3) The chief officer must ensure that members of staff of the agency give the Inspector any assistance that the Inspector reasonably requires to enable the Inspector to perform the Inspector's functions under this section.
