TERRORISM (HIGH RISK OFFENDERS) ACT 2017 - SECT 43
Ex parte application for emergency detention order
(1) The State may apply to the Supreme Court for an order for the detention of
an eligible offender (called an
"emergency detention order" ) who is the subject of an
extended supervision order or an interim supervision order and who, because of
altered circumstances, poses an unacceptable and imminent risk of committing a
serious terrorism offence if the emergency detention order is not made.
(2)
The Supreme Court may hear an application for an emergency detention order in
the absence of the eligible offender concerned.
