(a) a building or that part of a building intended for use by the general public, or
(b) a facility or building on public land or dedicated or reserved Crown land under the Crown Land Management Act 2016 for which the Council has care, control and management,unless that building, part of a building or facility is accessible to people with a disability in accordance with the relevant part of the Council's Better Living DCP and Australian Standard AS 1428.1-2001, Design for access and mobility--General requirements for access--New building work in the manner prescribed within that development control plan.
