CRIMES (ADMINISTRATION OF SENTENCES) REGULATION 2014 - REG 275
Consequences for staff members testing positive at least twice in 3 years
275 Consequences for staff members testing positive at least twice in 3 years
(1) This clause applies if-- (a) a member of correctional staff (other than a
staff member on probation, a temporary employee or a casual employee) tests
positive for alcohol, and
(b) the staff member has tested positive for
alcohol in the 3 years immediately preceding the test referred to in paragraph
(a).
(2) The Commissioner may deal with the matter under section 68 or 69 of
the Government Sector Employment Act 2013 .
(3) The Commissioner may refer
the staff member to a medical practitioner for the purpose of the medical
practitioner determining the staff member's fitness to remain a staff member.
(4) The Commissioner is to have regard to any report made by the medical
practitioner in relation to the staff member.
