ENVIRONMENTAL PLANNING AND ASSESSMENT REGULATION 2000 - REG 25B
Form and subject-matter of planning agreements
(1) A planning agreement must--
(a) be in writing, and
(b) be signed by the
parties to the agreement, and
(c) be lodged on the NSW planning portal, and
(d) be accompanied by the fee prescribed under clause 263B.

7.4(10) of the Act requires a planning agreement to conform with the Act,

practice notes to assist parties in the preparation of planning agreements.
Note : Under section 7.9 of the Act the Minister may give planning authorities
directions on requirements with respect to planning agreements.
(3) A council
that is negotiating, or entering into, a planning agreement must consider any
relevant practice note.
