Verification of presence of loose-fill asbestos insulation
68A Verification of presence of loose-fill asbestos insulation
(1) For the purposes of section 119B (2) of the Act, the presence of
loose-fill asbestos insulation at premises has been verified if-- (a) a
licensed asbestos assessor has investigated the premises to determine whether
or not loose-fill asbestos insulation is present at the premises, and
(b) a
NATA-accredited laboratory, which is accredited for the relevant test method,
has confirmed that a sample of material removed from the premises in the
course of the investigation is or contains loose-fill asbestos.
(2) In this
clause--
"licensed asbestos assessor" means a person who holds an asbestos assessor
licence under regulations made under the Work Health and Safety Act 2011 and
includes a person who holds an equivalent licence under a corresponding WHS
law (within the meaning of that Act).
"NATA-accredited laboratory" means a testing laboratory accredited by the
National Association of Testing Authorities, Australia (
"NATA" ) or recognised by NATA either solely or with someone else.
