UNIFORM CIVIL PROCEDURE RULES 2005 - REG 38.4
Venue of examination
38.4 Venue of examination
(1) Subject to this rule, the examination of a
person in respect of a judgment or order is to be conducted at the same venue
as that where the judgment or order was entered.
(2) If, in the case of
proceedings before the District Court, the Court is satisfied that the person
neither resides nor carries on business within 30 kilometres of the proclaimed
place where the judgment or order was entered, then the examination is to be
conducted at the proclaimed place nearest to where the person resides or
carries on business, as the Court may determine.
(3) If, in the case of
proceedings before the Local Court, the Court is satisfied that the person
neither resides nor carries on business within 30 kilometres of the venue
where the judgment or order was entered, then the examination is to be
conducted at the premises of the Court nearest to where the person resides or
carries on business, as the Court may determine.
