(1) An authorised officer or the Tribunal, as the case requires, is to hear and determine an application made under section 206.
(2) If an authorised officer or the Tribunal determines any such application by granting consent to the performance of a surgical operation or the carrying out of special medical treatment, as the case may be, on a patient or other person, the consent has the same effect as if it were given:(a) in the case of a patient or other person of or above the age of 14 years--by the patient or other person as if the patient or other person had capacity to give the consent, or(b) in the case of a patient or other person under the age of 14 years--by the parents or guardian of the patient or other person.
