This legislation has been repealed.
(1) A person who:(a) suffers from a Category 2, Category 3, Category 4 or Category 5 medical condition, and(b) is in a public place or other place of public resort (including any means of public transport), and(c) fails to take reasonable precautions against spreading the medical condition,is guilty of an offence.Maximum penalty: 50 penalty units or imprisonment for 6 months.
(2) It is a defence to a prosecution of a person for an offence under this section if it is proved that the person was, at the time of commission of the alleged offence, ignorant of the existence of the medical condition on which the prosecution is based.
