EXPLANATORY STATEMENT


GENERAL OUTLINE

This Bill amends the Building Act.

The purpose of this Bill is to provide the Director of Building Control with powers to resolve an impasse in the building certification process (for current, active building work) where an unforseen event (prescribed event) occurs. To achieve this it clarifies the responsibilities of persons and entities involved in the certification process and provides a mechanism for consumers to apply to the Director for an exemption for certain certification, where a prescribed event occurs.

NOTES ON CLAUSES

Clause 1. Short Title

This is a formal clause which provides for the citation of the Bill. The Bill when passed will be cited as the Building Legislation Amendment Act 2010.

Clause 2. Commencement

This clause provides for the commencement of the Act on a day fixed by the Administrator and notified by publication in the Gazette.

Clause 3. Act amended

This clause specifies the part that amends the Building Act.

Clause 4. Amendment of section 4 (Definitions)

Definitions have been included to reflect the amendments of this Bill.

Clause 5. Amendment of section 19 (Functions and powers of Appeals Board)

Section 19 of the Act required amendment to vest specific power in the Appeals Board to hear appeals from applicants regarding the Director’s decision whether to issue or refuse to issue an exemption certificate. A new subsection 19(ab) is proposed to be inserted to provide this.

Clause 6. New section 37A

37A No interference with building practitioner by corporation

The proposed inclusion of this provision is designed to ensure that nominees (or other qualified persons) of corporations are able to perform their duties as registered practitioners free from interference by unregistered directors or other unregistered people involved in the management of the corporation.

An offence is created for a person involved in the management of a corporation (a corporation that is a registered building practitioner) to interfere with the duties that a registered building practitioner must perform. An offence is also created for a corporation to prevent a nominee or other building practitioner from complying with a provision of the Act, or for interfering with that person in carrying out building work in accordance with the Act.

The offence provision is designed to provide a deterrent and will offer protection to nominees (or other qualified persons). The provision has been drafted to ensure that it encompasses all categories of building practitioners as all categories of building practitioners are part of the certification process and could be involved in an impasse situation.

Clause 7. Amendment of section 40 (Building certifier or Director may rely on certificate)

The existing provision allows for certificates issued under this section to be relied upon by a building certifier.

This clause proposes to include a reference to the proposed exemption certificates the Director will be able to issue, following the passage of this Bill.

Clause 8. Repeal and substitution of section 48C
