EXPLANATORY STATEMENT


GENERAL OUTLINE

This Bill amends the Criminal Code through the introduction of an additional circumstance of aggravation to section 188(2).

It provides that it is a circumstance of aggravation to common assault where the person assaulted is the driver of a commercial passenger vehicle.

NOTES ON CLAUSES

Clause 1. Short Title.

This is a formal clause which provides for the citation of the Bill.
The Bill when passed may be cited as the Criminal Code Amendment (Assaults on Drivers of Commercial Passenger Vehicles) Act 2008.

Clause 2. Commencement.

The Act will commence on a date to be fixed by the Administrator.

Clause 3. Act amended.

The Act amends the Criminal Code.

Clause 4. Amendment of section 188 (Common Assault)

This clause amends section 188(2) of the Criminal Code by inserting paragraph (fa) after paragraph (f) to expand the circumstances of aggravation to include assaults on drivers of commercial passenger vehicles, as defined in the Commercial Passengers (Road) Transport Act.

The maximum penalty for such an assault is five years imprisonment.
