EXPLANATORY STATEMENT


GENERAL OUTLINE

This Bill amends the Electrical Workers and Contractors Act.

The purpose of this Bill is to address the common expiry date of 30 June for electrical contractor licences, and allow contractor licence periods of up to three years, as in most other jurisdictions.

NOTES ON CLAUSES

Clause 1. Short Title

This is a formal clause which provides for the citation of the Bill. The Bill when passed will be cited as the Electrical Workers and Contractors Amendment Act 2008.

Clause 2. Act Amended

This indicates the name of the Act that is to be amended.

Clause 3. Amendment of Section 36 (Term of Licence)

Section 36(1) is omitted and a new clause is substituted which allows for new electrical contractor licences to remain in force for up to three years, at the Electrical Workers and Contractors Licensing Board’s discretion.

Clause 4. Repeal and substitution of Section 41 (Term of renewal)

Section 41 is repealed, and a new section 41 substituted which allows for renewals of contractor licences to remain in force for up to three years, at the Electrical Workers and Contractors Licensing Board’s discretion.

Clause 5. New Part 5

After section 56, a new part 5 is inserted. It is a transitional clause to apply revised expiry dates to existing electrical contractor licences due to expire on 30 June 2008. These revised expiry dates will fall due on the anniversary date of application. For example, a licence first issued on 2 November 2001 (and due to expire on 30 June 2008), will now remain in force until 2 November 2008.

Clause 6. Further amendments

Simply changes Part numbers from roman numerals to ordinary numbers.
