EXPLANATORY STATEMENT
GENERAL OUTLINE
This Bill amends the Health Practitioners Act and implements consequential amendments and transitional provisions as a result of implementing the National Registration and Accreditation Scheme (the national scheme) in the Northern Territory.
The purpose of this Bill is to: amend the Health Practitioners Act to remove references to the nine Northern Territory health professions that will join the national scheme on 1 July 2010; to include reference to radiographers as a health profession under the Health Practitioners Act; to repeal the Radiographers Act under which radiographers are currently registered; to make consequential amendments to other Northern Territory legislation to fully implement the national scheme; and to maintain legislative functions that will remain the responsibility of the Northern Territory, namely; pharmacy premises control and the Health Professional Review Tribunal.
NOTES ON CLAUSES
Part 1 Preliminary matters
Clause 1 Short title
This is a formal clause which provides for the citation of the Bill. The Bill when passed will be cited as the Health Practitioner (National Uniform Legislation) Implementation Act 2010.
Clause 2 Commencement
This clause provides for a commencement date of 1 July 2010 in line with commencement of the Health Practitioner Regulation (National Uniform Legislation) Act 2009 and the formal commencement date of the national scheme across Australia.
Part 2 Amendment of Health Practitioners Act
Clause 3 Act amended
This clause cites that Part 2 of the Bill provides amendments to the Health Practitioners Act.
Clause 4 Amendment of section 4 (Definitions)
This clause updates and defines terms in the Health Practitioners Act as they will apply in the Northern Territory.
Clause 5 Repeal and substitution of section 6
This clause removes reference to the categories of health care practice for those professions that will be covered by the national scheme and defines the category for the remaining health care professions in the Northern Territory. Radiography has been included as a new category of health care practice under the Health Practitioners Act because the Radiographers Act is subject to repeal under this Bill.
Clause 6 Amendment of section 7 (Establishment of Boards)
This clause removes reference to the establishment of boards for those categories of health care practice for those professions that will be covered by the national scheme and defines the establishment of boards for those remaining categories of health care professions in the Northern Territory.
Clause 7 New Part 2A (Pharmacy Premises Committee)
This clause: establishes the Pharmacy Premises Committee as a body corporate that will be responsible for administering the pharmacy premises control provisions in Schedule 8; provides for members to be appointed by the Minister with provisions for membership and administrative procedures set out in Schedules 1 and 2 respectively; sets out the functions of the committee in relation to Schedule 8; provides a general power to perform its functions; provides the capacity for the Committee to approve policies and guidelines in relation to Schedule 8 provisions; provides the ability for the Committee to delegate any of its powers and functions; provides for a Registrar to be appointed by the Minister; provision for the Committee to establish an advisory committee to assist in the performance of its functions; provides protection from liability for members and delegates of the committee; and requires the committee to provide an annual report to the Minister.
Clause 8 Repeal and substitution of section 19
This clause removes reference to the categories of registration and enrolment for those categories of health care practice for those professions that will be covered by the national scheme and defines the categories of registration for those remaining health care professions in the Northern Territory.
Clause 9 Amendment of section 20 (Application for registration or enrolment)
This clause removes reference to the application for registration or enrolment for those categories of registration or enrolment that will be covered by the national scheme and defines the categories of registration and application to established boards for those remaining categories of health care professions in the Northern Territory.
Clause 10 Repeal of section 29
This clause repeals a section relating to nursing, which is a profession that will join the national scheme.
Clause 11 Repeal and substitution of section 38
This clause omits a clause relating to an enrolled nurse, which is a profession that will join the national scheme.
Clause 12 Amendment of section 40 (Practising certificates)
This clause omits a clause relating to dental therapist or dental hygienist and to nursing and midwifery which are professions that will join the national scheme.
Clause 13 Repeal of section 44
This clause repeals a section relating to nursing, which is a profession that will join the national scheme.
Clause 14 Amendment of section 99 (Right of appeal)
This clause: inserts a new clause to specify that a party to a notification under the Health Practitioner Regulation National Law (NT) may appeal to the Supreme Court against a decision of the Tribunal; and to specify conditions under which a person the subject of an appellable decision may appeal against a decision of the Tribunal.
Clause 15 New section 102A
This is a new section to establish conditions under which radiographic procedures may be carried out for the purpose of the Health Practitioners Act. These provisions have been carried over from the Radiographers Act, which is subject to repeal under this Bill.
This section provides clauses to specify a person who must not carry out a radiographic procedure and provides exemptions to these conditions under certain circumstances.
Clause 16 Repeal of section 130
This clause repeals reference to Schedule 8, which has been replaced by new provisions under clause 7 (New Part 2A) and makes reference to Schedule 8.
Clause 17 New Parts 10 to 12
This clause explains that new Parts 10 to 12 are inserted after section 133 of the HealthPractitioners Act as detailed in the following clauses. These are transitional provisions in relation to radiography to ensure the continued application of certificates and decisions made under the Radiographers Act, which is subject to repeal under this Bill.
Part 10 Transitional matters for radiographers
Clause 134 Definitions for Part 10
This clause provides definitions for the purpose of Part 10.
Clause 135 Radiographers Board membership
This clause provides transitional provisions for the transfer of existing members of the Radiographers Board to the new Board under the Health Practitioners Act.
Clause 136 Registrar
This clause provides that the current Registrar of the Radiographers Board will be taken to be the Registrar of the new Board under the Health Practitioners Act.
Clause 137 Register
This clause provides for the current register of radiographers to be the register of the new Board under the Health Practitioners Act.
Clause 138 Registered radiographers
This clause provides for the current registration of radiographers to be registration under the Health Practitioners Act. The next round of registration for radiographers will fall in line with other professions under the Act.
Clause 139 Suspension of registration
This clause provides that a current suspension of registration will cease on the date it would have ended under the RadiographersAct had it not been repealed.
Clause 140 Pending application for registration
This clause provides that a pending application for registration will be decided under the Health Practitioners Act.
Clause 141 Pending application for restoration of registration
This clause provides that a pending application to restore registration will be dealt with under the Health Practitioners Act but in accordance with provisions of the Radiographers Act. A subsequent certificate of practice is to be issued under the Health Practitioners Act.
Clause 142 Pending appeal
This clause provides that a pending appeal will be dealt with under the Health Practitioners Act but in accordance with provisions of the Radiographers Act. A decision is to be given under the Health Practitioners Act.
Clause 143 Interpretation Act not affected
This clause explains that the Interpretation Act is not limited by this Part.
Part 11 Transitional matter for pharmacists
Clause 144 Pharmacy standards
This clause retains existing standards which apply to premises from which a pharmacy business or pharmacy service is conducted and defines the day on which this section commences.
Part 12 Transitional matter for Health Practitioner (National Uniform Legislation) Implementation Act 2010
Clause 145 Notification being dealt with on commencement day
This clause clarifies the application of section 289 of the Health PractitionerRegulation National Law to existing cases on commencement day. It reiterates that existing cases are to continue to be dealt with under the Act of the participating jurisdiction under which the notification was made, as if that Act had not been repealed. The clause specifies that the Act of the participating jurisdiction for the purpose of the Northern Territory is the Health Practitioners Act.
Clause 18 Amendment of Schedule 1 (Membership of Boards)
This clause changes references from Boards to Regulatory Bodies, which includes health practitioner boards and the pharmacy premises committee.
The clause removes reference to Board membership and provisions for those categories of health care practice that will be covered by the national scheme and specifies Board membership for those remaining categories of health care professions in the Northern Territory including radiography. The clause also inserts membership provisions for the pharmacy premises committee.
Clause 19 Amendment of Schedule 2 (Provisions with respect to membership of Board)
This clause changes references from Board to Regulatory Bodies and removes provisions in respect to the membership of Boards and election of the Chair for those categories of health care practice that will be covered by the national scheme and defines the terms Chairperson used in respect to the membership of Boards for those remaining categories of health care professions in the Northern Territory.
Clause 20 Amendment of Schedule 3 (Provisions with respect to meetings of Board)
This clause changes references from Board to Regulatory Bodies, removes provisions relating to categories of health care practice that will be covered by the national scheme and specifies terms for a quorum at a meeting of a regulatory body.
Clause 21 Repeal and substitution of Schedule 7
This clause removes reference to the categories of protected titles for those categories of health care practice for those professions that will be covered by the national scheme and defines the categories of profession and title for those remaining health care professions in the Northern Territory.
Clause 22 Amendment of Schedule 8 (Provisions relating to pharmacies)
This clause provides a reference to the new Section 18 under New Part 2A, which relates to provisions under Schedule 8.
Clause 23 Further amendments
This clause refers to further amendments of the Health Practitioners Act, which are listed in Schedule 1 of this Bill.

Clause 24 Act amended
This clause names the Act which is being amended in the following clauses.
Clause 25 Amendment of section 21 (Medical procedures)
Amends the definition in section 21(2) of a medical practitioner or person to refer to the Health Practitioner Regulation National Law (NT).
Division 2 Cross-border Justice Regulations

Clause 27 Repeal and substitution of regulation 32 to 34
This clause repeals regulations 32 to 34 and adds an additional section (38A) which was added to the Mental Health and Related ServicesAct in order to give standing to medical practitioners registered in South Australia, Western Australia or the Northern Territory working in the Cross-Border region of NT/SA/WA.

Regulation 38A Definitions
This regulation expands the definition in this division of approved treatment facility and authorised psychiatric practitioner. The additional regulation which was added to the Mental Health and Related ServicesAct in order to give standing to medical practitioners registered in South Australia, Western Australia or the Northern Territory working in the Cross-Border region of NT/SA/WA. It will no longer be necessary to make specific reference to medical practitioner registration in the participating jurisdictions once the Health Practitioner RegulationNational Law commences in the NT.
Regulation 33 New Section 41A
This clause amends an additional section (41A) which was added to the Mental Health and Related ServicesAct in order to give standing to medical practitioners registered in South Australia, Western Australia or the Northern Territory working in the Cross-Border region of NT/SA/WA. It will no longer be necessary to make specific reference to medical practitioner registration in the participating jurisdictions once the Health Practitioner Regulation National Law commences in the NT.

This regulation expands the definition in this division of approved treatment facility. Regulation 34 New Part 10, Division 1A

Clause 28 Repeal and substitution of regulation 40
This clause amends modified section 132(1) of the Police Administration Act which is used to give standing to medical practitioners, registered nurses and enrolled nurses registered in South Australia, Western Australia or the Northern Territory working in the Cross-Border region of NT/SA/WA. It will no longer be necessary to make specific reference to health practitioner registration in the participating jurisdictions once the Health Practitioner Regulation National Law commences in the NT.
Clause 29 Repeal of regulation 42
This clause amends modified section 145(14) of the Police Administration Act which is used to give standing to dentists registered in South Australia, Western Australia or the Northern Territory working in the Cross-Border region of NT/SA/WA. It will no longer be necessary to make specific reference to dentist registration in the participating jurisdictions once the Health Practitioner Regulation National Law commences in the NT
Clause 30 Repeal and substitution of regulations 58 and 59
This clause amends modified sections 3 and 3A of the Traffic Act which give standing to registered nurses and medical practitioners registered in South Australia, Western Australia or the Northern Territory working in the Cross-Border region of NT/SA/WA. It will no longer be necessary to make specific reference to registered nurse and medical practitioner registration in the participating jurisdictions once the Health PractitionerRegulation National Law commences in the NT.
Clause 31 Repeal and substitution of regulation 62
This clause amends modified section 5(1) of the Youth Justice Act which gives standing to medical practitioners, enrolled nurses and registered nurses registered in South Australia, Western Australia or the Northern Territory working in the Cross-Border region of NT/SA/WA. It will no longer be necessary to make specific reference to nurse and medical practitioner registration in the participating jurisdictions once the Health Practitioner Regulation National Law commences in the NT.
Division 3 Education Act
Clause 32 Act Amended
This clause names the Act which is being amended in the following clauses.
Clause 33 Amendment of section 25 (Child not to attend school in certain circumstances)
This clause omits the definition of medical practitioner in section 25(3) as medical practitioner is already defined under the Interpretation Act.
Clause 34 Amendment of section 72 (Medical and dental inspections)
This clause also amends the definitions in section 72 of a nurse and dentist to refer to the Health Practitioner Regulation National Law (NT).
Division 4 Evidence Act

This clause names the Act which is being amended in the following clauses.

This clause replaces the reference to Health Practitioners Act with a reference to the Health Practitioner Regulation National Law (NT) in the definition of registered nurse.

Clause 39 Act amended

Clause 40 Amendment of section 4 (Interpretation)
This clause expands the definition of Board to include a National Board established under the Health Practitioner Regulation National Law (NT), a NT Board established under the Health Practitioners Act or another entity prescribed by regulation.
Clause 41 Amendment of section 73 (Information to Board)
This clause amends section 73(1) so the Commissioner must provide to the relevant Board, information received in conducting an investigation of a complaint against a registered provider. It also amends section 73(2) to say that the relevant Board may use the information in exercising its powers and performing its functions.
Clause 42 Amendment of section 75 (Commissioner may be party to proceedings by Board)
This clause clarifies section 75(1) by specifying that a Board may take proceedings against a registered provider in respect of a matter relating to or arising out of a complaint or investigation of a complaint under this Act.
It also adds an explanatory note after section 75(2) of the Act, which directs persons to section 194 of the Health Practitioner Regulation National Law (NT) for information about parties to proceedings taken on a notification made under that law.
Clause 43 Repeal and substitution of section 89
This clause changes the provision for inconsistency in section 89 of the Health andCommunity Services Complaints Act, so that in the case of an inconsistency between this Act and the Health Practitioner Regulation National Law (NT), the Health Practitioner Regulation National Law (NT) will prevail.
In the case of an inconsistency with the Health Practitioners Act, the Health andCommunity Services Complaints Act will continue to prevail.
