JUSTICE LEGISLATION AMENDMENT (PENALTIES) BILL 2010

EXPLANATORY STATEMENT


GENERAL OUTLINE

This Bill amends 62 Justice Portfolio Acts and seven pieces of subordinate legislation for the purposes of:

(a) moderately increasing all penalty amounts expressed in dollar amounts by approximately the same amount, being 15%; (b) expressing all monetary penalties in penalty units; (c) modernising the way that penalty provisions are drafted by using the words “Maximum Penalty:” where the word “Penalty:”
is currently used; and

(d) increasing the imprisonment term for the offences of perverting the course of justice in the Criminal Code.

NOTES ON CLAUSES

Clause 1. Short Title.

This is a formal clause which provides for the citation of the Bill.
The Bill when passed may be cited as the Justice Legislation Amendment (Penalties) Act 2010.

Clause 2. Commencement.

The Bill will commence on such day or days as are determined by the Administrator.

Clause 3. Amendments

Clause 3 provides for a schedule of amendments.

Clause 4. Repeal

The Bill will repeal the Justice Legislation (Penalties) Amendment Act 2009 which was assented to on 29 December 2010 but was not Gazetted as having commenced.
