EXPLANATORY STATEMENT


GENERAL OUTLINE

§ The Bill repeals the existing Legislative Assembly (Register of Members’ Interests) Act 1982 as amended, and puts in place an updated scheme for registering and disclosing defined pecuniary interests of Members of the Legislative Assembly and those closely related to them.

NOTES ON CLAUSES

Clause 1. Short Title

This is a formal clause which provides for the citation of the Bill. The Bill when passed may be cited as the Legislative Assembly (Disclosure of Interests) Act 2007.

Clause 2. Commencement

Specifies that the Act commences on the date fixed by the Administrator by Gazette notice.

Clause 3. Definitions

Defines key words or phrases used in the Act.

Clause 4. Registration of Members’ Interests

This clause sets out the obligations of a Member of the Legislative Assembly in regard to making a statement in regard to their registerable interests, those of related persons, and any alteration of these interests.

Clause 5. Register of Members’ Interests

This clause sets out the requirement of the Clerk of the Assembly to keep a Register of Members’ interests and to make it available for public inspection under conditions specified by a Committee of the Assembly.

Clause 6. Contempt of Legislative Assembly

This clause sets out the consequences of a Member’s failure to provide a statement of their interests, or alterations, or in providing false or misleading information. Through the Legislative Assembly (Powers and Privileges) Act penalties include fines or imprisonment.

Clause 7. Repeal

Sets out the former Act, and the amendment Act, which are being repealed.

Schedule

Sets out the registerable interests and the required information that must be provided about these interests. The interests include shareholdings, interest as beneficiary in a trust, land holding, directorships, partnerships, debts, bonds, saving accounts, major assets, gifts, sponsored travel or hospitality and any other interest where a conflict of interest with a member’s public duties could foreseeably arise or be seen to arise.
